note out of san francisco firefighters are battling a one alarm blaze in the hayes valley neighborhood. >> a fire broke out in the 200 block of oak street near octavia boulevard around to 45 this morning. >> off no word on what caused the fire. we have a crew there will get an update shortly. >> and other area news the city of oakland has passed a controversial measure to hire former new york and los angeles police chief william bratrton as a consultant. >> the council members approved the contract with a seven to one vote. >> an amendment exercising one of the policies will not permit any racial profiling. >> there were mixed emotions about hiring present at the meeting. >> over the past week, both police chief howard and mayor jean quan aesthetically and strenuously the racial profiling not be tolerated in the police department. >> stop and frisk. i do not

>> the manhunt for the suspects involved in a shooting of an undercover officer in oakland is over. police have in custody five men are believed to have gained ties. >> the shooting happened monday night between seminary in harmon ave. police say, the officer was working as part of a new violence reduction crying team and was alone when he was confronted and shot by several suspects. >> the officer is now at home recovering from his injuries. >> sexual assault allegations against 49ers star wide receiver michael crabtree do not appear to be holding up under investigation. >> investigators say there were looking into a complaint that crabtree had assaulted a woman at a hotel party after the 49ers defeated the green bay packers in a playoff game earlier this month. >> however, witnesses tell investigators that crabtree did not assault anyone and police have not found any physical evidence of the attack.

>> welcome back. the time is 4:10. >> class will resume today at lone star community college in houston. a 22 year-old man has been charged in the texas get the shooting. that left him and two others wounded. carlton barry is charged with aggravated assault. he is still in the hospital this morning. investigators say, a fight between two people escalated and as a shock for fired. a man is man was caught in crossfire. the other victim is not been identified. fortunately, no one died in the shooting. >> a top general cott up in the petdraeus scandal, has been cleared of allegations that he road potentially inappropriate e-mail to afford a socialite. >> the defense department found the allegations
